The Promoter takes data protection seriously. By entering this competition, you confirm that you have read the Privacy Policy, and agree to these Terms and Conditions. By submitting any information/video required as part of their entry into the campaign, entrants agree to their information being held and processed in accordance with the General Data Protection Regulations (GDPR).

These Terms and Conditions (“Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of these Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by them. Please retain a copy for your information.

Eligibility

The #CokeDunks competition (“Competition”) is open to GB (England, Scotland & Wales) residents only. Excluding employees and their immediate families of Coca Cola Great Britain, Coca Cola European Partners, their subsidiaries, affiliated companies, agencies, or anyone else professionally connected with the competition.

Entrants must be 16+ years or over. (Under 18s require parental/legal guardian consent to enter and will need an adult to attend the event with them).

Entrants must have access to the internet and an active Facebook, Twitter or Instagram (Instagram Stories) or twitter account. If you do not have a Facebook, Instagram or twitter account you will need to create one in order to participate – you will require an active email address in order to do this. Proof of ownership of the social media account and proof of age may be required.

No purchase necessary.

There is no limit to the number of unique entries that can be submitted by an entrant. During the competition. However, duplicate entries on any platform will be disqualified. Anyone trying to circumvent this condition by using alternative details or setting up multiple Facebook, Instagram or twitter accounts or aliases will be disqualified. A maximum of one prize may be won per person.

Promotional Period

The competition is open from 00.01 Monday 10th September 2018 and closes on Sunday 23rd September 2018 at 23:59:59.

Entries outside these competition dates will not be included.

At the end of the competition, all valid entries will have been judged to deliver a shortlist of 11 which will then be further discussed between the judges to give a final winner and 10 runner ups.

Due to the timing of “Recycle week” the winners / runners up will be contacted and be expected to return required information within 12 hours to ensure their win can be validated.

How to Enter

Entrants must submit an original, current personal video showing a recycable plastic bottle being dunked into a recycle bin on Instagram, Instagram stories, Facebook or Twitter. Dangerous, obscene or inappropriate entries that contain dunking will not be accepted.

The video must also include any at home, or outdoor (public or privately owned) bin that is clearly marked as an “official” recycling bin. Only official recyclable bins will be acceptable.

Only valid entry videos will be accepted. All entry details and content are subject to verification and interrogation.

The video must be in an uploadable format M4A, MP4, 3GPP, AVI, WebM or MPG4 and a max length of 1 minute,and must be uploaded on the above mentioned platforms using the hashtag #CokeDunks.

Entrants need to remain following https://twitter.com/CocaCola_GB or https://www.facebook.com/cocacolaGB/ or https://www.instagram.com/cocacolaeu/ for the duration of the promotion period and fulfilment period following the end of competition. To enter from a private account, you must amend your account settings to a public account in order for entry to be accepted. The account must remain public until the end of the competition and fulfilment period in order to be contacted in the event your entry is a winning entry.

The Competition entry submission must be original, created and taken by them and cannot infringe the copyright or other intellectual property rights of any third party. Any entry video found to be copied, doctored or amended or plagiarized, will be disqualified.

The video must be filmed currently and has to be unique for this competition and cannot be a re-use of work entered in any other competition or event.

Obscene or inappropriate entries will not be accepted. Entrants are solely responsible for the content they provide and any views highlighted in the video.

All potential winners are subject to verification of eligibility and compliance with these Terms and Conditions and the requirements of Coca-Cola the brand.

Entrants further agree that no content will be submitted that:

  • Is known by you to be false, inaccurate or misleading;
  • A risk to personal or public health;
  • Uses individuals in the video whose permission has not been granted;
  • Encourages or advocates any unlawful or unauthorized behaviour or activity or violates any law, statute, ordinance or regulation;
  • Is offensive, obscene, vulgar, or is inappropriate for a public and family friendly forum;
  • Contains references to Individuals smoking tobacco, drinking or appearing to be under the influence of alcohol;
  • Is, or may be considered to be, defamatory, libellous, hateful, racially or religiously biased or offensive, threatening or harassing to any individual or entity;
  • Includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or
  • Contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files;
  • Infringes any third party’s copyright, patent, trademark, trade secret, rights of publicity rights of privacy, moral rights or any other applicable personal or proprietary rights.

The Promoter and their agents reserve the right, but not the obligation, to:

  • Monitor or review the Video Content you have submitted;
  • Remove or refuse take forward as an entry any Content submitted that the Promoter deems in its sole discretion to be inappropriate or violate any of these Terms and Conditions without giving you notice;
  • Forward any inappropriate videos to the necessary authorities.

The Promoter does not guarantee that you will have any recourse to edit or delete any Video Content you have submitted. The Promoter has the right to remove or refuse to accept any entry for any reason. You acknowledge that you, not The Promoter, are responsible for the Contents of your submission. None of the Content that you submit shall be subject to any obligation of confidence on the part of the Promoter, its agents, subsidiaries, affiliates, or third-party service providers and their respective directors, officers and employees.

It is the responsibility of the winners to provide their correct, up-to-date details at the time of acceptance in order for their prize to be processed. The Administrator, nor its fulfilment agent can be held responsible for the winners failing to supply accurate information which affects prize acceptance.

No entries from agents, third parties, organised groups, syndicates will be accepted. No incomplete, corrupted entries or multiple entries from the same person outside of the Terms and Conditions will be accepted (where applicable).

The entry must be made directly by the person entering the competition. Syndicated entries, multiple entries or accounts or those made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed, and all such entries will be disqualified.

Prize Details

Grand Prize

There will be one Grand Prize of a THORPE PARK Resort OR Alton Towers Resort experience for the overall winner of the Competition who will be chosen by a judging panel.

The prize will consist of a choice of one of the following:

THORPE PARK Resort:

  • A one-night stay for 4 in the THORPE Shark Hotel including breakfast

10 x Runner Up Prizes

The 10 runners up will win a pair of Odeon cinema tickets for entry to any normal 2D film and a Merlin attraction one day standard entry ticket to either Alton Towers Resort or THORPE PARK Resort for two people.

Prize covers one day theme park entry for up to two people. Valid until 31/10/2018 excluding secondary ticketed events (including but not limited to Ministry of Sound, Fright Nights, Scarefest). The pass is for entry into the theme park only and does not include food or drink.

THORPE PARK Resort and Alton Towers Resort reserves the right, in its absolute discretion, to refuse entry and to close and/or alter all or any part of the facilities including closure of rides and/or attractions for technical, operational, health and safety or other reasons including overcapacity. Size, height, weight, age restrictions and medical warnings apply to certain rides and attractions.

The Promoter reserves the right to add more prizes into the main promotion. Winners only will be notified in line with these Terms and Conditions.

Winner Selection Process

All valid entries will be judged against the stated criteria by a panel of judges all from valid entries received

The judging panel will consist of a panel of judges, Sean Kellett, Charlotte Davies, Emma Juner and one independent auditor, all who have the experience in this type of competition. Judging will take place using an independently verified process so that everything can be audited throughout

The judging will take place throughout the competition (depending on entry numbers) and up to 28th September 2018 with the final list of winners and runner ups, being decided upon before the end of the day on 28th September 2018.

All entries will be judged on merit based on the criteria:

  1. Original and unique
  2. Innovation
  3. Overall impression/presentation and content
  4. Level of detail and the video quality
  5. Style and tone of execution
  6. Relevance to the Brief in the theme of the video

The judging panel will individually score, and these marks will be subsequently ranked across their entries and all entries to find the top 11 videos (or tied 11th) to subsequent review to find an overall winner.

Once a shortlist from all the judge’s entries have been established, there will then be dialogue between the judges and overseen by an independent adjudicator to establish the top video from all those shortlisted.

In the event of a tie situation, the highest score from a combination of original and unique will take precedence to determine the winner.

Claim Process for the Runner up and Overall Winner

The overall winner and the 10 runner ups will be notified via a comment on their promotional post with next step instructions on the Social Platform used to participate in the Competition

The winner will be notified first and will be required to follow next steps, within 12 hours of being notified that they are a winner. All reasonable steps will be taken to contact the winner, but if this cannot be achieved within the allotted times scale then the Promoter reserves the right to cancel the prize entitlement, withdraw the win and award the prize to the entry with the next highest ranked video as awarded by the judging panel.

The Promoter will make reasonable efforts to contact the winners and then after contact will subsequently communicate a secure link to allow potential winners to provide the Promoter information securely including their name, re confirm their Facebook, Twitter or Instagram details and a valid home address and / or email address to assist with verification, fulfilling the claim and arranging the prize. Inaccurate information may result in the prize being forfeited

Once a grand Prize winner has been confirmed, the process for all the other runners up will commence using the same principles as above.

All Winners agree to take part in any reasonable publicity without further recompense.

Prizes are non-transferable and cannot be sold or auctioned. Any person found in breach of this term will be disqualified from participating. No alternative prize will be available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter or Prize provider. The Prize Provider reserves the right to offer a suitable alternative of equal or greater value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the Winner.

Prize Fulfilment

The runner up prize will be dispatched to the winners by registered post via next day special delivery once winner has been verified. The Promoter accepts no responsibility for failed delivery due to provision of incorrect contact details. Any prize that is returned undelivered will be assumed unwanted and the Promoter reserves the right to select an alternative winner to swap or receive the prize, if time permits, using the same process referred to above in these Terms and Conditions.

The Promoter will share personal information with its marketing agency and other partners who will be supporting the Promoter with the promotion, including with providing prizes. The Prize Provider, Merlin Entertainments will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. General Terms and Conditions

The winners are responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize.

All entries submitted, and all information provided by entrants must be complete and accurate.

This competition is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. Any information you provide as part of this promotion is provided to the Promoter and not to Facebook, Instagram or Twitter. Entrants to this promotion hereby release Facebook, Instagram or Twitter from any claim or liability suffered in connection with this promotion.

No cash or other alternative gift available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter, the Promoter reserves the right to offer a suitable alternative of equal or greater value.

The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, or any instructions forming part of this Competitions entry requirements, or otherwise where a participant has gained unfair advantage in participating in the Competition or won using fraudulent means.

The Promoter is not responsible or liable for:

  1. Any submissions that are lost or delayed due to faulty, failed or erroneous electronic data transmissions communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines satellites, servers, computers or providers utilized in any aspect of this Competition causing delays or disruption;
  2. Claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of posting will not be accepted as proof of receipt as a result of inaccessibility or unavailability of the internet;
  3. Insofar as permitted by law, any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the competition.

The contents of all entries submitted become property of the Promoter. The Promoter reserves the right to use the contents of entry submissions provided by entrants, for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law. Each Eligible entrant grants permission for Promoter to use the video contents of his/her entry submission for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content, are theirs to assert. Participants warrant that the materials contain no copyright materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.

Data Protection: The Promoter will only use the personal details supplied for the administration of the Competition and as part of the Competition and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulations (GDPR). The winner agrees to participate in any reasonable publicity required by the Promoter with no recompense.

The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, or any instructions forming part of this Competitions entry requirements, or otherwise where a participant has gained unfair advantage in participating in the Competition or won using fraudulent means.

In the event of unforeseen circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right to modify or suspend the Competition or these Terms and Conditions, either in whole or in part, with or without notice but will always endeavor to minimize the effect to participants in order to avoid undue disappointment.

The Promoter’s decision in all promotional matters is final.

Any person posting, or seen to be posting, comments during the Competition that are considered bullying, spiteful or upsetting to other participants, associates or directly aimed at the Promoter, will have their comments removed and will be disqualified from the Competition. The Promoter reserves the right to alert the relevant social media platforms to any such behaviour, which may result in the person’s account being frozen pending investigation.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

The Competition and these Terms are governed by English law and subject to the exclusive jurisdiction of the English and Welsh courts.
